By registering at our site you agree that you have read, understood, and agree to be bound by these Terms. We also have Terms and Conditions that apply to our cannabis consumption Sessions, as specified in our Gateway Tutorial.

Definitions:
On this page and throughout this site, the following definitions apply:
“HeartFlower” refers to the are division of Joygenic Living Inc. that operates the website  HeartFlower.ca and publicizes our services, including live or online events, Sessions, meetups, parties, and field trips.
“Service” or “services” refer to any service or services offered by HeartFlower, including access to the content of the website, and participation in any live or online events, Sessions, meetups, parties, and field trips.
“staff” indicates HeartFlower employees, agents, contractors, and volunteers who may from time to time interact with participants leading up to, during, and after participation in our services.
 

Our services are restricted to adults
Access to our services is permitted only for people above the legal age of majority in the jurisdiction where the services are received.

Our right to decline services
For the benefit and support of all our participants and staff, HeartFlower has full discretion to remove anyone from our services who fails to comply with the directions of our staff or any ethical or safety guidelines, including but not limited to, the use of other psychoactive materials, dishonesty, harassment, or causing psychological or physical danger to the staff or other participants.
 

Confidentiality and privacy
HeartFlower will not release to anyone information about participants in our services, including their identity or personal characteristics, unless required by law. For further information on our website privacy policy go here.
 

Some of our in-person or online services includes a discussion during which participants disclose personal details. If you access our services you:

a) will not disclose to anyone information about participants attending our services, including their identity and personal characteristics, or the fact they have attended our services.
b) will not record the event by photography, audio or video recordings, writing or any other means.

c) understand that there is a slight risk that attendees at our services may breach this term and release confidential information about other attendees.

 

For educational or promotional purposes HeartFlower reserves the right to discuss or write about participants’ experiences during our services, but will not reveal any identifying information about the participant. No photograph or video taken by HeartFlower or its staff during our services that includes identifying information will be publicly released, unless the identified parties give written consent.
 

Event Tickets Policies
All ticket sales are final. If there was a charge for the ticket, we do not offer refunds, except for cancelled events.
If you can't make the date for a service, email us within 24 hours of the Session start to get a credit to attend a later Session of the same type.

 

Intellectual property
All content provided at our website including but not limited to music, audio, sounds, video, photos, graphics, text, and information is proprietary material belonging to HeartFlower, or its staff, or third parties, and is protected by copyrights, patents, trademarks, trade secrets or other proprietary rights.

Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
 

Right to change services
We may, without prior notice, change the services we provide; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Right to suspend access
We may permanently or temporarily terminate or suspend your access to HeartFlower without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

Right to Change Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. Your continued use of HeartFlower after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) our services.

Governing Law
This Agreement, and all claims or causes of action (whether in contract, tort or statute) that may be based upon, arise out of or relate to this Agreement, or the negotiation, execution or performance of this Agreement (including any claim or cause of action based upon, arising out of or related to any representation or warranty made in or in connection with this Agreement or as an inducement to enter into this Agreement), shall be governed by, and enforced in accordance with, the internal laws of Province of British Columbia, including its statutes of limitations. The parties irrevocably submit to the exclusive jurisdiction of the courts of the Province of British Columbia, Canada.
